Fundamentals of the legal status of citizens of India are the same, but they are determined by the articles of the Constitution, of unequal significance.

Social and economic rights are formulated as policy guidelines, with the resulting characteristics of their judicial remedies; other rights are attached to the other articles of the constitution.

The actual implementation of these rights in the specific conditions of the country is variable and depends on such factors as the remaining elements of the system of Varna and the level of development of ethnic groups.

Fundamental civil rights are guaranteed by constitutional guarantees. In case of violation, a citizen may apply to the court of any jurisdiction, including the Supreme Court, the latter may be forced to take a decision, while the lower court can not declare a law unconstitutional – its jurisdiction is only to enjoy the fundamental rights. The rights that are attached to the section on policy guidelines, such assurances are not provided.

The Constitution establishes the equality of citizens before the law, forbids discrimination on grounds of religion, race, caste and gender.

Among the social and economic rights we can single out the right of protection from exploitation, from the number of policy guidelines – the right to work, of adequate means of livelihood, protection from economic exploitation, the public assistance in case of illness or unemployment, the right of subsistence, Children right of compulsory free education.

Political rights include the traditional rights and freedoms such as freedom of speech, press, freedom of association and others.

Among the personal freedoms, the Constitution asserts the inviolability of the person (with the exception of emergency situations, when prolonged preventive detention without trial is allowed), freedom of movement, home and correspondence. The Constitution abolishes untouchability or belittling of one of the castes.

The Constitution of India describes the main duties of citizens, many of which has not legal, but moral character. The civic duties include: adherence to the ideals and institutions of the country, respect for the national flag and national anthem, military duty, the duty to follow the ideals of national liberation struggle, to develop a scientific approach, to show humanity to strive for excellence in all areas of individual and collective activity.
